The Short

The Guardian reports that the Court of Appeal upheld a family’s challenge to deducting a TT$939,006 workplace-safety fine from civil compensation. The ruling itself was not obtained for this report.

The Full Story

The case followed a workplace accident in 2012 in which an oil worker suffered injuries and died the next day. According to the Guardian’s report dated 4 November, the companies accepted liability in 2017 and a High Court Master assessed compensation in March 2021.

The newspaper says the Master deducted a TT$939,006 fine imposed over occupational-safety breaches, as well as workmen’s compensation, from the assessed loss of earnings. The family challenged the treatment of the fine.

The Guardian reports that the Court of Appeal upheld that challenge in a judgment delivered late the previous week. Its account distinguishes a statutory penalty from a compensatory payment intended to cover the same economic loss, even where a court directs that the fine benefit a victim’s family. The exact judgment date, final payment calculation and whether any further appeal has been filed were not independently established. This is an attributed account of that case, not advice about other compensation claims.
